Terms of Service — Plurakey

These Terms of Service ("Terms") govern your access to and use of the Plurakey website (plurakey.com), the Plurakey configurator, and any related services (collectively, the "Service") provided by Plurakey LLC ("Plurakey," "we," "us," or "our"). By using the Service you agree to these Terms.

1. Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service in any way that violates applicable laws or regulations
Attempt to gain unauthorized access to any part of the Service or its infrastructure
Transmit any harmful, offensive, or disruptive content through the Service
Reverse-engineer, decompile, or disassemble any part of the Service, except as permitted by law
Use automated tools to scrape, crawl, or index the Service without our written permission

2. Accounts

To access community features, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials. You must notify us immediately at [email protected] if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.

3. Community Profiles

The Community section allows you to share keybind profiles with other users. By submitting a profile, you:

Represent that you own or have the right to share the content
Grant Plurakey a non-exclusive, royalty-free license to display and distribute the profile within the Service
Acknowledge that shared profiles are publicly visible
Confirm that the profile does not contain protected health information (PHI) or any other sensitive personal data

We reserve the right to remove any profile that violates these Terms or that we determine, in our sole discretion, is inappropriate.

4. Hardware and Configurator

The Plurakey hardware device is sold subject to a separate purchase agreement. The configurator software is provided as-is to program your device. You are responsible for ensuring that any keybind configurations you deploy comply with your organization's policies and any applicable regulations.

Plurakey is not liable for any clinical or operational consequences arising from the use of custom keybind configurations in medical or professional workflows. Use of the configurator in safety-critical environments is at your own risk.

5. Intellectual Property

All content, software, designs, and trademarks on the Service are the property of Plurakey LLC or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission. "Plurakey" and "Plurakey" are trademarks of Plurakey LLC.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLURAKEY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Plurakey LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Governing Law

These Terms are governed by the laws of the United States and the state in which Plurakey LLC is incorporated, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in that state.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on this page. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
